Are your unpaid interns illegal?


Given the lack of paid internships and the overwhelming amount of aspiring magazine editors, Ed can pretty much bet that every whippersnapper has had at least one unpaid internship. In fact, sometimes it seems that media wouldn't be able to survive without a bevvy of unpaid interns to transcribe, research, report, write, photocopy, and sometimes make a coffee run.

But it turns out unpaid internships may be illegal. According to the NYT, "when the jobs are mostly drudgery, regulators say, it is clearly illegal not to pay interns." States like California and Oregon have already begun fining employers for violating the law. (Ed gave his own two cents on the topic in an Ask Ed years ago). But now the federal government plans on cracking down on what many people consider to be 21st century slave labor. Even internships with college credit are not exempt.

Federal regulators say that receiving college credit does not necessarily free companies from paying interns, especially when the internship involves little training and mainly benefits the employer.
The article cites an unnamed fashion intern who "spent an unpaid three-month internship at a magazine packaging and shipping 20 or 40 apparel samples a day." Another Edster blogs about being Ivy Leagued and Unemployed after spending years as an unpaid intern during college. 

Ed admits that unpaid internships can benefit the employer more so than the intern. Good luck telling that to your employer and still getting a great recommendation...

And often, these opportunities cater to the wealthy who can afford to take a semester off from making money. But at the same time, Ed highly doubts that the magazine industry has enough money to start paying the thousands of interns it employs.

  1. I've been going back and forth in my head trying to decide what's better: tons of unpaid internships that offer experience and that "foot in the door" or a significantly smaller number of paid internships that could be as hard to obtain as a Birkin...

    I've already had two unpaid internships as a college junior and will probably take another this summer (although I do have a freelance offer... which I'll most likely pair with an unpaid internship just to maximize my summer).

  2. I think it will be difficult to crack down on all the unpaid internships because of the wide range of experiences people have had. I have heard horror stories about people having to walk their boss's dogs, bringing the outfits they expect to wear for a week in advance, and have had bad experiences of my own with over-the-top bosses who know that there are students aplenty willing to work for free. Unpaid internships are okay when you're allowed to learn and work in a respectful environment. The past two unpaid internship experiences I have had were great because I felt like I was guided along in the learning process. I wasn't expected to get anyone's coffee--they understood I was giving my time and in turn expecting to learn the ways of the media world. I feel like there should be someone to turn to--maybe a new hotline to report instances of unfair circumstances. At a past full-time summer internship, I was working five, nine-hour days a week, while the designer chain smoked in the small showroom everyday. I was expected to complete sales calls, sell merchandise, sweep, fetch coffee, while she never acknowledged my presence until about two months in. I was also yelled at for taking an hour lunch once. She told me I was the bottom of the chain as an intern, and should have seen no one else went out for lunch. My direct supervisor made it worthwhile to stay because she was polite and was very approachable. She was also a great wealth of knowledge, so in the end, I gained more than I lost.

  3. I think the worse part is requiring college credit. College credit means that while I was in college and accepted into internships for college credit my college would charge me tuition for those units to count! To pay $550 a unit to files papers, yeah then it's not worth it. I understand if they can't pay me but dont make ME pay for it!

    Completed one internship at a non-profit book publishing place and another for a women's online celebrity blog site. Both these helped for my current position as a publications assistant for a journal.
    So yes it does count but it cost me more student loans :(

  4. I think internships should without a doubt be paid. I am one of the fortunate ones that have my parents to help with traveling costs to NYC and family members in Staten Island NY that allow me to sleep (or i should say practically live at their homes), but honestly I still have to keep my part time retail job at the mall just to have that little bit of cash at the end of the week and to not be in the negative when it comes to money. Also, I definitely do think that some internships are just worth even the experience, BUT I am on my 3rd internship now and only one was absolutely informative and showed me exactly what went on in a magazine where my other 2 (one that i am still doing now!) included coffee runs, transcribing interviews and sending out personal packages. Being paid would make it a lot more worthwhile and easier on the wallet. Now that NJ transit is going up 25% internships NEED to pay their interns something. Also, if there then turned out to be less internships, I think I would like the challenge of getting one because it honestly seems like companies will hire anyone willing to work (or should i say volunteer) for no money.

  5. I think that interns should definitely be paid at LEAST a small stipend covering transportation. I'm trying to get an art/graphic design internship and it seems like small design firms are more likely to offer a bit of payment. Too bad that big name publishing companies very very rarely offer paid part-time internships. I'm currently an intern for a non-profit and everyone, even the full-time employees, barely make anything but they love with they do. Also, they seem really grateful for their interns. My supervisor used to drive me from school to the work site (30 min. away!) and she lets me work from home.

    Anyway, I think paying minimum wage wouldn't hurt the company THAT much. It benefits the intern (he/she will get paid AND won't have to deal with the whole internship credit business) as well as the company (what's worse, risking a legal suit by offering unpaid internships, or offering your intern ~$100 a week?)
